In order to survive a motion to dismiss (the earliest stage at which a suit can be kicked out of court), a RICO claimant must show that conduct of an enterprise through a pattern of racketeering activity that includes the commission of at least two predicate acts caused injury to the plaintiff's business or property.
The conduct of the enterprise and the defining of the enterprise is easy here. There's an obvious pattern and there are (by my count) 6 predicate acts thus far. The biggest hurdle would be the injury part. The right to vote is neither buisness nor property, so we'd have to find something else. Some cases talk about conspiracies to force people to vote a certain way so that one business benefits (i.e. slot machines). It's worth kicking around. What do you guys think.
